1. Introduction
Welcome to Artazest. These Terms of Service ("Terms") govern your access to and use of the Artazest website (www.artazest.com), including any purchases made through our online store (the "Store"). By accessing or using our Store, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Store.
Artazest is an Aalsmeer-based company specialising in acoustic panel artworks. Our Store is operated on the Shopify e-commerce platform.
2. Eligibility
By using our Store, you represent that you are at least 18 years of age or are accessing the Store under the supervision of a parent or legal guardian. You agree to provide accurate and complete information when placing an order.
3. Products & Orders
All products displayed on our Store are subject to availability. We reserve the right to limit quantities, discontinue products, or modify product descriptions at any time without prior notice.
By placing an order, you are making an offer to purchase the selected product(s). We reserve the right to accept or decline any order. An order confirmation email does not constitute acceptance of your order; acceptance occurs only when the product is dispatched.
We strive to display product colours and dimensions as accurately as possible. However, slight variations may occur due to monitor settings, lighting conditions, and the handcrafted nature of our products.
4. Pricing & Payment
All prices are listed in euros (€) and include applicable VAT for EU customers, unless stated otherwise. Prices are subject to change without notice; however, any changes will not affect orders that have already been confirmed.
Payment is processed securely through the payment methods available at checkout. You agree to pay the full amount due, including any applicable shipping costs and taxes. All payments must be received in full before your order is dispatched.
5. Shipping & Delivery
Once your order is placed, please allow 5-10 working days for your artworks to be carefully prepared and delivered. Each piece is individually packaged to ensure it arrives in perfect condition.
Upon shipment, you will receive an automatic email with track and trace information so you can follow your order. Shipping is free within the EU. For orders outside the EU, shipping costs are calculated at checkout based on your location. We ship throughout Europe and internationally.
Risk of loss and title for items purchased pass to you upon delivery to the carrier. Artazest is not responsible for delays caused by the shipping carrier, customs processing, or events beyond our control.
6. Customs & Import Duties
For orders shipped outside the European Union, customs duties, import taxes, or other charges may be applied by your local authorities upon arrival. These fees are not included in our product prices or shipping costs and are the responsibility of the buyer. We recommend contacting your local customs office for information on applicable charges before placing your order.
7. Returns & Refunds
You have 30 calendar days to return an item from the date you received it. To be eligible for a return, items must be unused, in the same condition you received them, and in the original packaging.
Return shipping costs are the responsibility of the customer, in accordance with our Return Policy. Custom or personalised products and items marked as final sale cannot be returned.
Once we receive and inspect your return, your refund will be processed and applied to your original payment method within 10 working days. Original shipping costs are non-refundable.
If you receive a damaged or defective item, please contact us immediately at hello@artazest.com with photos of the damage. We will arrange for a replacement or full refund at no additional cost to you.

8. Intellectual Property
All content on the Store — including but not limited to images, text, designs, logos, artwork, graphics, and product descriptions — is the property of Artazest or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, display, or use any content from the Store without our prior written consent. Purchasing a product does not grant you any intellectual property rights to the artwork or design depicted on or within the product.
9. User Conduct
When using our Store, you agree not to use the Store for any unlawful purpose, attempt to interfere with the operation of the Store, impersonate any person or entity, or submit false or misleading information. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if we suspect any violation of these Terms.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Artazest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Store or purchase of any products.
Our total liability to you for any claims arising from these Terms or your use of the Store shall not exceed the total amount paid by you for the specific product(s) giving rise to the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
11. Disclaimer of Warranties
The Store and all products are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Store will be uninterrupted, error-free, or free from viruses or other harmful components.
While we take great care in crafting our acoustic panels, slight variations in colour, texture, or dimensions may occur due to the handmade nature of our products. These variations are not defects and are part of the unique character of each piece.
12. Indemnification
You agree to indemnify, defend, and hold harmless Artazest, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Store, your violation of these Terms, or your violation of any rights of a third party.
13. Third-Party Links
The Store may contain links to third-party websites or services that are not owned or controlled by Artazest. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. We encourage you to read the terms and privacy policy of any third-party website you visit.
14. Force Majeure
Artazest shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, strikes, government actions, supply chain disruptions, or infrastructure failures.
15. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data. By using the Store, you consent to the collection and use of your information as described in our Privacy Policy.
16. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.
For consumers within the EU, this does not affect your statutory rights under mandatory consumer protection laws of your country of residence.

We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the Store following the posting of revised Terms constitutes your acceptance of such changes.
